January 15th, 2010 To all our faithful customers; We write today with some bad news. Over the last number of weeks we have been
heavily attacked by legal representatives of Mr. Ari Emanuel and William
Morris Endeavor, LLC. Mr.
Emanuel and his company believe that we have been attempting to trade off
their name in seeking to promote 'SuperAgent' and in doing so, are misleading
the public into thinking that Mr. Emanuel and/or WME endorse the game. We have never done this. Not only do we know we have no
authorization to use their names, we see no benefit in doing so either, as
for the most part, the public don't even know who they are. Notwithstanding the fact that we
believe their allegations are without merit, we have been advised by our
legal team that defending this dispute against WME/Mr. Emanuel (should they
decide to sue us as they have threatened) would be far too costly for us to
sustain. We simply don't have
the cash to take on a massive Hollywood agency and its principal Mr. Emanuel. Mr. Emanuel's and WME's legal advisors
repeated their threat to Apple, who were forced to withdraw the app from the
store on December 23rd, 2009. The resulting lack of sales over the Christmas period has
been devastating financially, and we therefore have had to abandon our fight
to keep SuperAgent alive and cancel the competition that was running. The competition largely relied on
gaining sales until the closing date of January 31st, 2010 and
with only having 3 weeks sales, its simply not feasible (financially) to
continue it. To all those who bought the game, please
accept our apologies. We never
intended for this to happen, indeed, we will make a significant loss on our
development costs of the app and would've liked to avoid this situation, that
has simply not been possible. We can only hope that some of you will come
back to us in the future when we launch other apps, and it is up to us to
repair the damage done by this legal case to our reputation. We will do all we can in that regard. Thanks again for your custom in the past and
for playing the game. If there are any questions, comments or
complaints please feel free to let loose at bluesky@factorysix.com we'll try
to reply to everyone. Everyone at FactorySix ( If you are looking for the old superagent website it is available by
